Florida Probate and How Palm Beach Property Owners Avoid It

Probate is the court-supervised process of settling a person’s estate, and for Palm Beach property owners it is often the main thing they want to avoid. Real estate makes probate slower and more expensive because title cannot transfer cleanly until the court has acted. Understanding how Florida probate works, and the tools that keep property out of it, helps owners protect their families from unnecessary delay and cost.

Two Kinds of Florida Probate

Florida’s Probate Code (Chapters 731 through 735) provides two main paths. Summary administration is a streamlined option available for smaller estates. Formal administration is the full, court-supervised process and is generally required when the estate exceeds $75,000 in non-exempt assets or when the death occurred within the past two years. Because a single Palm Beach home or condo can exceed that figure, real-estate owners frequently fall into the formal category unless they plan ahead.

Why Real Estate Complicates Probate

When real property passes through a will or by intestacy, the personal representative must inventory it, protect it, keep up taxes and insurance, and often obtain court authority before selling. Buyers and title companies will want to see that probate has properly vested title before they close. Heirs who hoped to sell quickly can find themselves waiting through a public, months-long proceeding.

Tools That Keep Property Out of Probate

Florida offers several ways to transfer real estate outside probate. A revocable living trust holds title so the property passes under the trust terms. A Lady Bird (enhanced life estate) deed lets you keep full control during life and pass the property automatically at death without probate. Properly structured joint ownership with rights of survivorship can also pass property to a co-owner. Each tool has trade-offs, especially where homestead protection under Art. X, Section 4 of the Florida Constitution is involved.

Homestead and Exemptions

Florida’s homestead protection can shield the primary residence from many creditors and may pass it to a spouse or heirs with special treatment, sometimes outside the usual probate distribution. Homestead rules are nuanced, and how the home is titled and devised determines the outcome. Note that Florida imposes no state estate or inheritance tax, so probate planning centers on transfer and title, not state death taxes.
